Pittsfield power plant vows to fight $5 million federal fine levied over alleged overcharging for power
PITTSFIELD — The Federal Energy Regulatory Commission is seeking a $5 million fine against the owners of a Pittsfield power plant, claiming that Canada-based Maxim Power Corp. knowingly overcharged ISO-New England for power it generated during July and August of 2010.
FERC says Maxim defrauded ISO-New England of $3 million in part by claiming its Merrill Road power plant was burning oil to generate electricity when it was actually burning less-expensive natural gas, the Berkshire Eagle reported. Maxim willingly paid back the $3 million, and now FERC wants to levy an additional fine.
